What is collaborative law ?

Collaborative law is an alternative conflict resolution methodology that allows lawyers to facilitate negotiations in a collaborative, honest, and sincere fashion, without sacrificing tenacity in the defense of their client’s interests. 

Collaborative law implicates and guides the client throughout the resolution process enabling them to take a lead role

It is a process in which all parties protagonise in the search for solutions.

The negotiation process carried forth collectively by the clients and the collaborating lawyers.

Other professionals such as mediators, coaches, psychologists, and notaries can; if necessary, collaborate with the parties seeking resolution.

Collaborative law characteristics

Collaborative law unfolds through a process grounded in the parties’ needs and interests, where techniques and tools for managing conflict, emotions, and interpersonal dynamics play a central role.

Collaborative lawyers are trained to use these tools. When acting as collaborative lawyers (a temporary role, not a permanent one), they agree that if no satisfactory agreement is reached, they will not represent the client in any dispute over the matter.
